Anyone use the Montana LLC tax loophole? - April 19, 2012, 08:49 AM

... for buying a RV/expensive car?

Basically creates a LLC in montana (0% sales tax, can title a car there without being physically present) that you can buy a car through to "avoid" personal property tax/sales tax/etc.

While technically legal, I think you run into a grey area because in VA if you have a car here longer than 90 days you have to title it in VA.

So I imagine there would only be trouble if some police officer notices the montana plates and makes a stink about it.

Just wondering if anyone did this or knew of anyone who had?

just ask osama, oh wait. I do know this if you do get caught Va will make you pay the pp tax for the time it was here. i had a issue like this i had to deal a few years back.

do it in maryland. start a business, buy it for the business, cheaper than owning a car in maryland. and you cant get in trouble cause its a company car.

next car that's what im doing. I already paid the asinine taxes on the treg.

Provided you can prove that you're using it for a majority of business use, that's a good scheme.

I'll give you a hypothetical story of a person who used to live in Ballston, but his bikes were registered out of state.

If you park on the street - even in unrestricted places where you can park all week - cops check for out of state vehicles. This said person received an informative ticket saying that if he gets another one, he has to go to county court and explain what the vehicle is doing in the state and why it doesn't have VA plates.

Same thing happened when this person would get pulled over. While never getting into any trouble, it is only a matter of time before a cop decides to write you up for it.

Chances are that when you get caught all you will have to do is register the vehicle here and pay taxes from that day forward, but who knows, they may have some penalties in store for you as well.

Lastly, it's not a 'loophole'. It's braking the VA law, plain and simple.

Yeah, I know about Osama - he's the one who told me about it. That wasn't the reason he went down though.. I guess it helps bribing loudoun county sherrifs to look the other way.
