First off, My Bad if this info has been posted here... Next, My Disclaimer: I'm looking up the info and sharing just like everybody else. I ain't VA, nor do I represent VA, so take it or leave it~

To all of you with a lead foot/wrist out there. Effective July 1, 2007 in our wonderful Commonwealth of Virginia, any traffic ticket, with the exception of regular speeding, will carry heavy civil penalties (yes, this is a new charge) in addition to the fine and court costs that you will have to pay.

Here are just a few............

Driving on a suspended or revoked permit - Civil penalty $750.00 + the court cost & fines

Reckless Driving - Civil penalty $1,050.00 + the court cost & fines

DUI - 1st offence - Civil penalty $2,250.00 + the court cost & fines

Failure to give proper signal - Civil penalty $1,050.00 + the court cost & fines

Leaving the scene of an accident - Civil penalty $3,000.00 + the court cost & fines




Be careful when you drive/ride. Tell your friends.

This is BS fuggin VA trying to make more money. If these laws work in VA. What makes you think that DC and MD will not try to pass these laws in the future.

Is anyone aware of a group that is actively organizing resistance to this bullshit?

Every VA lawmaker who voted for this needs his ass kicked out of office.

As a side note - many on here know I used to be a legal junky - and I'd think this law could be challenged under the 14th amendment - equal protection clause. It applies only to VA drivers and not all drivers.

Another interesting thing I heard recently, someone can correct me if I'm wrong - an illegal alien driving without a license convicted of reckless driving faces a lower maximum fine than a citizen would face with a similar charge driving on a suspended license - because the alien doesn't have a virginia driver's license, they're exempt from the additional penalties.

so I've been doing some more reading on this - apparently, there is an important reason these are termed "civil fees". If it is a FINE - then the equal protection clause applies - different classes of people would be facing different "punishment" for the same crime. However, if it is a TAX - then the 14th amendment wouldn't apply because taxes apply only to state residents... BUT!! Most in the General Assembly are loathe to say they are introducing a new TAX or raising TAXES, even though that is their goal.

The result? "Civil Fees" or "Civil Penalties"- Taxes without the name "TAX" - in the form of fines without the 14th amendment problems.

Virginia, you have voted some SERIOUSLY shady folks to the general assembly.
