Can conversation with Cops be recorded? - March 20, 2017, 09:12 PM

Question from a curious mind, is it legal(or illegal) to record conversation with a cop, if being pulled over, while sitting in your car? Provided no drugs, being sober and all of that good citizen stuff

Broadly, and with a strict interpretation of the constitution and some case law, yes.

reality: depends on your state. Depending on the state you may end up fighting it in court.

In MD yes. There was a case back in 2010 where a motorcyclist recorded a cop. They tried to get him with wire tapping. Judged ruled it legal.

Don't get me wrong....most cops do a great job....but some have a bad day and take it out on others....

Two years ago, I was out one sunny morning walking my dogs (two golden retrievers, on leash) when an unmarked Crown Vic comes tearing around the corner, slams on the brakes and two uniformed "officers" jump out, run at me and spin me around, push me up to the squad car and force me face down onto the hood and start frisking me.

Now, ya gotta understand...I'm a sixty plus year old semi-bald, white-haired semi-fat lump.....

I'm stammering "What's going on...what are you doing?" and all I get is "Is there anything in your pockets that would injure us?" in return as they continue to pat me down.

Next thing I know, they're putting cuffs on me and telling me I'm under arrest! I'm freaking out! They've pried the leashes out of my hands and the dogs are milling around.

At that moment, a guy comes running down the street yelling "No No No No! Wrong guy, that's not him!"

Seriously, the guy had to tell them about four times that I wasn't who they were looking for before they unhooked me.

I never did find out who they were looking for and for why, as all they did was free my wrists, tell me I was free to go. No apology, no explanation..nothing. They just hopped back in the car with the other guy in the back and took off......

I was shaken and later more than a little pissed off, I called the police district, told them what happened. They took the info; when I called to follow up, I was told they had no record of any such interaction at my location. No apology, no promise to look into it....

Yea...I'm a fan of video cameras....
