Clearance Question HEEEEELP! - November 6, 2007, 08:09 PM

I have my security seminar tomorrow. On one of the forms it says the followings:

For question 9, your answers shold include convictions resulting from a plea of nolo contendere (no contest), but omit (1) traffic fines of $300 or less, (2) any violation of law committed before your 16th birthday, (3) any violation of law committed before your 18th birthday if finally decided in juvenile court or under a Youth Offender law, (4) any conviction set aside under the Federal Youth Corrections Act or similar state law, and (5) any conviction for which the record was expunged under Federal or state law.

I have asked several people what the question above means and I have received different answers.

Quick run down, I got in trouble with Johnny Law when I was younger 17 and the records were expunged. Do I have to list those records?

According to my hooked on phonics reading it says leave out right?

I got a secret clearence. CAT 2. I'll tell you one thing i know for sure. If you leave it out, there is a way for them to see that it was expunged.

you do not need to list it. when they do your check, they most likely will see it, but it should not count against you in this case.

You seem to have answered your own question in (5)--you can leave it out. However, I am also curious about your first sentence. It seems you have a security seminar, which implies that you will have some instructors or teachers providing information about security. Can you raise this question with them before you fill out your form?

Best bet is to just tell the truth with explaination

Some Public Trust thing for Customs and Border Protection. Yea I'll have instructors there tomorrow to help me out. They gave us the drafts to fill out because I believe tomorrow we get the real thing and we have 5 days to turn in all the paperwork then meet up with a investigator?

Expunged or tried as a juvenile doesn't count. Only adult convictions. Wreckless tickets, however, are not traffic violations but a misdameanor offense.

Carnage, if they have this listed as an exception ("omit it"), then you do not need to document it. It means it is outside the scope of their investigation.

No worries that "they will see it if they pull your record", because it won't happen. That statement tells you they are not going to investigate that. So omit it. It's not even going to be on the table.

I deal with these on a daily basis (yes my job is that boring) anyways, leave it out. If they find it and determine its an issue, they will send an agent out to interview you and when asked why you did not list it, tell them you deemed it insignificant as you were a juvenille. My juvenille history as been a non issue for both my clearance investigations.

you can omit it from the form, they can still see it if they investigate. if you ever get asked about it by one of their investigators, tell the truth about it and explain why you left it out.

Leave it out. They ask that you omit expunged records. You may be asked about if you apply for positions with "other" government agencies as certain places conduct their investigations differently. Still though, you are following directions.

Provide only the info they ask for but answer honestly. Your investigator will thank you.

Reveal everything. Even expunged stuff shows up. I got something dropped from my record and it was still there. They are not to prosecute. They want to see if you have anything to hide from it. I have a TS/SCI w/ ci poly.
