DC's Finest Strikes Again! - September 11, 2011, 08:07 AM

We've all experience this same old bullshit, or know someone who has...

I'm driving my cage south on 14th through a very busy Columbia Heights on Saturday afternoon. The pace is crawling stop n' go because there's heavy pesdestrian traffic in crosswalks left, right and in front. Cars are making left turns or right turns, so they have to sit in the box until there's a break in the moving chain of humans...

Now for my beef! I hear the short blasts of the siren and look in my rear view mirror to a DC Patrol Car busting it's muffler weaving through traffic and coming up fast. I pull over to the right curb to allow it to pass, but it screeches to a halt behind me... Being a Bro, I know the routine... I turn off my Ice-T/Public Enemy/NWA Mix CD, roll down the window, leave my bluetooth in my ear, keep my seatbelt on and keep both my damn hands on the steering wheel at 10 & 2.

The next thing I know, I've got DC's Finest standing in the blind spot and screaming about "Do you know why I stopped you? You're getting two tickets - one for driving up on somebody's bumper and one for not using your turn signal!"... He proceeds with "What, are you in a hurry or something? You can't drive so close to someone elses car! You were this close to his bumper! Blah-Blah-Blah... He finally asks for my license, registration, ins... and I collect it all and give it to him.

He comes back after forever with my docs and two tickets, one for a freaking 100 bucks each!

I drove back through and got pictures... The stretch I was going through only has one lane to go straight and one lane to make a right turn. The driving genius two cars in front decided at the last second that he/she needed to make a right turn, hit the breaks, and tried to do so from the "straight" lane. They were stopped because of people in the cross walk, so I navigated around them on their left. I'm not quite sure where the LEO was but he had to be behind me, so how the hell can he legitimately make this subjective call?

I am absolutely going to the Court Hearing (that has to be scheduled by the DC Court for when his next scheduled time to be there is)... My question is what would yous guys say in your 1 minute to speak?

(1) You should have not been driving in DC this weekend. MPD is on high alert and are saturating DC - and saturation like this usually leads to bullshit (see: overly stringent enforcement). Every officer in the department is working a shift this weekend regardless if it is their day off or not. I haven't touched my car at all.

(2) People use turn signals in DC? You weren't turning - why would need to use your signal? You weren't changing lanes either (I don't think you have to signal lane changes), only moving around a car that decided to make an illegal right hand turn in front of you.

(3) Get ready for a bag of suck; in my experience with trying to fight tickets in DC is a fruitless effort. They rarely relent or overturn them even after your 1 minute statement or explanation.
You may get lucky if the officer doesn't show. I would do this trick:
Wait for your court date - two weeks before, write in for a continuance.
Usually on the second date, the officer pulls a no show or cannot recall the events.

Sounds like your case is going to be a 'he said she said' one. And almost always, the judge sides with the cop.

It also sounds to me that you are upset over how the cop approached you on the matter than your violations itself.

I would just pay the tickets, save time and aggravation, and put it in the past.

Wow! I can't believe so many people believe in "just pay the ticket and move on". Basically to agree that police officers are allowed to have a power rush, that the city can use you as their source of unjust revenue, and that the system is perfect the way it is.

The cop did come up with an attitude = unwarranted, unnecessary, and unprofessional
The cop was behind him = how can he honestly tell the distance between the drivers front bumper?
The never made a turn or a change of lanes = why the legal need for turn signals?

I don't know DC but if Heist is right that fighting tickets in DC is pointless then I recommend you go at it with the mentality of an attorney. Look at the codes on the books for both infractions and question the police officer directly about what he recalls. If his statements do not fulfill the requirements of the official statutes then the ticket is unenforceable. (i.e. if he did not physically witness the distance between your bumper and the guy in front then he needs to define another source with which he based his estimate of distance) Remember that the officer is a "witness" and as such must have valid recollection of the day's events to back up his claims, and he can be fully questioned by the defendant's side of the bench. FYI...I heard from somewhere that an officer must answer questions in court based on memory and is not supposed to use notes during questioning. This is just something I heard so look it up for confirmation if you want to go this route.

At the very least, go to court and show the judge your pictures with time stamps. GL

Sounds like some serious bs. I think everyone who works/lives in DC and drives/rides with any balls at all is going to eventually get lit up. My routine is usually one or two parking-related tickets each year that I don't waste my time fighting. One was for $100 for "parking on a sidewalk" which was just me locking my SMC to a sign post during the Cherry Bossom Debacle. I just consider it a charitable donation to DC which has a lot more problems than I have.

Just pay the fine, which you're gonna end up doing anyway after wasting an afternoon in court, after which you'll probably find a parking ticket on your car.

You actually got pulled over in DC? Especially in Columbia Heights?! Those officers usually have the mindset that unless you are really driving erratically, they wont bother - they have other stuff to deal with in that area than your driving. I say go to court and fight it.

yeah i wouldn't show them that pic which will get you another ticket for using ur cell while driving...lol

i say if you got good evidence then fight that shit. but if you lose then you shoulda just paid the ticket.

just send it in denying it. I do it all the time usually they just drop the ticket. out of 7 times i've sent them in only twice did i have to pay.
