Hey all.

This is the story I was heading home today with my girl. Her name is on the rental car and she was falling asleep behind the wheel. We was about 30 min away from my house and I said I will drive. I was o most home and got pulled over. we both got a ticket for driving a car I was not authorized to drive because of the rental agreement.

The charge is Ta 18106 B.

I thought that was just in case of an accident, if not covered by the rental agreement then the insurance you bought for it won't cover.
If your personal insurance covers rentals then you would be fine.

Now the rental does have a registration that goes with it and you probably handed it to the officer but strange that he would give a ticket because it wasn't in your name and the person was with you but oh well who knows.

In the end, your question is about a lawyer. If it isn't a moving violation aka points involved which I would assume it doesn't, pay it and be done. A lawyer won't get you out of it and just cost money unless you speak to one and they tell you that you shouldn't have ever gotten that to begin with.
I have used justanswer.com in the past that have lawyers you can ask questions.
I used them in addition to a divorce lawyer when mine didn't answer me in a way that I felt was sufficient. It's not cheap but cheaper than a lawyer.

how illegal is it to let someone else drive your rental car?

I don't know what to tell you on this one, other than that it is a dumb law that does not belong among traffic offenses. These is a contract matter between you and the rental company. I have never heard of this offense before and wonder how many states have it in use.
As it is written it appears you have no way out- plead ignorance. Apologize. Maybe shed a few tears... You are looking at a fine of some sort. I can't imagine it being too much, but the government is greedy so you never know. The fine will have court fees on top of it too. You shouldn't have any effect on your license or insurance.



18-106. Unauthorized use of rented motor vehicle.
(a) Lessees permitting other persons to drive rented motor vehicles.- If a person rents a motor vehicle under an agreement not to permit another person to drive the vehicle the person may not permit any other person to drive the rented motor vehicle.
(b) Rental agreements prohibiting other persons from driving vehicles.- If a person rents a motor vehicle under an agreement not to permit another person to drive the vehicle no other person may drive the rented motor vehicle without the consent of the lessor or his agent.

Driving a rented motor vehicle in violation of rental agreement.

Me:

Charge: TA18106 A

Checked with Virginia State Police, we are from VA and rented the car there, and there is no citation for this.

What a shitty deal. I dont think you need a lawyer, but if you have the time/patience, go to court. Explain the situation to the Judge...you were coming back from a long trip, your girl was getting tired, you were nearly home, and rather than endanger everyone on the road, you decided to take for the last leg. With any luck he will overrule the officer and lecture him for being a fuckin idiot. Or, maybe Captain Discretion won't show up and it will be dismissed.

That cop must have been hurting for tickets. Its probably easier just paying it and moving on but then again the judge may see your point of view.
