Not me haha. still sucks ass for me. One night at work (I drive a big rig locally) I was driving and saw this car driving all over the f'ing road. I called the cops. I follow the guy until he pulls over on the shoulder and then a few mins later the car slowly rolls into a ditch. Long story short they arrest him and now I receive a subpoena to go to court! GRRRRRR! hell no, I am not getting up at 7am to drive to bel air to point the finger at the guy, drive back home (hour each way) just to drive back up there again at 6pm for 12 hrs of work!!!!!!!!!1!!!! I dont even remember what the guy looks like. I've never been up on the stand, I freeze up just fighting a speeding ticket. Anyone have experience with this? What happens if I skip out? No one actually handed me the subpeona, it was mailed. Damn mailman always losing my mail......eh? maybe??

I love getting screwed for doing the right thing.

Don't sweat the stand - the AUSA will probably prepare you beforehand, letting you know what questions he/she will ask. BE HONEST - if you don't know the answer, say so. The defense attorney, if he/she is worth a grain of salt, will question you, but the AUSA should prepare you for that as well. Don't worry about being on the stand - the first few seconds up there are tense, but you'll settle into it quickly. Oh, and be polite and don't attempt to use words you don't typically use (your testimony is more than adequate without using big words).

Have fun putting someone in jail!!

OK first off either decide you will show up at the court date or just tell them to forget it. If you do not show up he will get off. If they defence lawyer is any good he will waste time and try to even postpone it. Tell the truth and be confidant of what you say. Since you are a driver you word means alot. Yes I have been done this exact same path as a DWI witness. I missed 3 days of work not paid for a scumbag to plea out at the last minute cause I kept showing up. I was so pissed that I had to be escorted out. BTW I even pulled the scumbag out of his buring car that hit the armco headon.

Just think of the family you might save by keeping him off the road. I totally understand not wanting to go - but I give you major respect if you stick it out and get 1 more azzhole off the road.

If I recall, one of our own was hit by a drunk driver recently and his gf killed.

thanks for that little push. I dont know Ryder personally but I sure as hell would not want anyone else to have to go through that, so I'm going. Thanks for the advice dodge and whisper.

Call the clerks office and let them know if you are or are not coming. IF you ignore it, you risk the potential of a Bench Warrant being put out for you.

If you say you cant come, be prepared that the DA "might" tell you dont have a choice. See Bench warrant statement above.

Yea before I got the subpeona the state attorney's office gave me a friendly call. she said to show up early and I will be briefed. I am thinking the guy will fight it because when the cops showed up the car was already in the ditch, so they did not witness him driving.

I'm pretty sure they can still get him for just being behind the steering wheel. Or did you say the guy was in the ditch, not the car? This guy I knew in college had a friend who was drunk and pulled over to the side of the road to sleep it off a little. Well the cops pulled up behind him and woke him up, he was escorted to jail and got a charge. I'm not sure it is was a DUI exactly, but he lost his license. Good luck.

just go and put this asshole in jail . it could of been u he hit instead of the ditch or he could of killed someone . people like that need to b put away . if makin a hour drive will put a potential killer behind bars its well worth it. if u don't appear u will b issued a fta and they will serve a bench warant if I'm not mistaken. I just lost a loved one to a drunk driver put him in jail.
