Contacted a seller a while back about a "Buy it now" item. Price was high so I asked if he'd take an offer. He replied a couple days later and said he'd take my offer but that I had to hurry because he had a lot of people "emailing" him about it. Ok so I took my time and sent him an offer about 3 days later; never heard back. Next day I see the item is sold. Never heard any more about it, and I figured one of the "emailers" must have snatched it up before me.

Meanwhile, a week goes by and a similar item appears in a different store for MUCH cheaper so I bid right away. I am currently the high bidder, and it's gonna end inside of 24 hours. Well I happen to see that I have a new message. It's freakin' ebay with a notice that the first seller opened a non-payment complaint against me. I'm like, uh, WTF? How the hell could I have known that I was the actual buyer, and the jackwagon didn't even try to contact me first before opening a dispute.

I consider this a misdeal because the sale was never confirmed or agreed upon by the seller. What say you?

First he only had "Buy It Now". Then I contacted him because it had been listed for a while. He said he'd accept the offer and that he'd set it up with a "or Make Offer" option, which he did. So then I sent an offer, and that was the end of all communication. I wondered what was going on and checked the item. It just said "Ended/Sold". No invoice, no nothing.

Well I would tell ebay exactly what happened and that you have already bought another item. It is on him to contact you withing a reasonable amount of time with an Ok on No on your offer.

Exactly! Plus I started wondering if maybe I missed something, but there was never any "You have one item you need to pay for" or any of that usual stuff. There was NO WAY for me to know that this deal was closed. The fact that he opened a dispute without taking the smallest trouble to contact me and close the deal really annoys me so I'm sending my rebuttal to ebay by fax. Believe me, there are going to be glossy photos with circles and arrows on them sent too.

That crossed my mind too, but seller has an ebay store so seems unlikely. I think it's just a case of a lazy-azz seller.

Hmm, I poked around a bit to see whether I missed anything. NOW I see a little message at the top of my browser window for the item description that shows my offer was accepted. This is VERY easy to miss. Shit.

There was no acceptance of your offer, therefore you don't have a valid contract. He doesn't have a leg to stand on. Just tell ebay what happened and your fine.

Yeah, I think I might be liable for this one. Ebay used to send messages when you won shit. Now there is just some little bullshit at the top of the item description. WTF? VERY easy to miss, if you don't know what to look for, which I didn't. FACK!!!
