Most states have laws against it in place for a long time now. People need to stop and think about things before generalizing so much. The purpose for sodomy laws is not to restrict what you do with your legal, consenting partner, but to restrict what you do with your under-age and/or non-consenting partner that is not supposed to be your partner at all. You cannot be prosecuted for being a creep--there has to be a law violated.

For example, let's say a man forcefully sodomizes a woman who did not consent to the encounter. If it's vaginal, it's rape. If not, then it's nothing unless there is a law that says it is something. The sodomy laws are in place to protect victims.

Think it over, folks. Make sure you understand why a law is in place or proposed before reacting against it.

So why don't they say "anal and oral are now considered rape as well if it's not consensual"? rather than "anal sex is illegal"

that's fucking dumb that rape doesn't cover anal and oral in the first place. i didn't know that

I wonder the same thing, to be honest. My speculation though is that it may have been tried this way and found inadequate. Another possibility is that when a violent attacker faces multiple charges, it's more likely that at least one will result in a conviction and more jail time. I imagine that both the victim and the justice system desire a violent sex offender face the most jail time possible. A conviction of a count of rape AND sodomy >> than a conviction of rape.

Of course the legal system would never be used to selectively apply the laws, discriminating against unpopular groups.

Until quite recently "your legal, consenting partner" could only be your legal spouse. Even then there were laws that defined what you could and couldn't do with your spouse. 'Sodomy' was illegal for even legally married couples to engage in. (JIC for any one doesn't know, that means none of this )

Code that no one's bothered to change since no one follows it any way. Besides if those statues get changed then how can we haul them out when there's someone we want to get rid of?
