Legal Question - December 3, 2007, 01:32 PM

For all you legal beagles, quick question. Since Cingular was bought out by AT&T, cingular no longer exists. Am I still required to fulfill my contract? Basically, I switched to T-Mobile and now AT&T wants a fee for breaking my contract, however, I never had a contract with AT&T, mine was with Cingular.

When Sprint and Nextel merged, they didn't ask me if I wanted to continue service with Sprint. My account stayed active, and I kept getting bills plus some propaganda about the merger. I think you're screwed, unfortunately.

I had the same question a while back. I reread my contract and unfortunately, mine stated (as I bet most do) that the obligation I have is not terminated by the sale of the contract. Still, maybe there's a requirement of notice they didn't provide you! You might have recourse if you read your k over. Did they change your terms at all when they bought it from Cingular? You might have an out. Either way, welcome to T-Mobile.

You have to continue to pay until the contract is concluded. Or pay the break the contract fee. My bank was Columbia First, which got bought by First Union, which merged with Wachovia. Wachovia could have said "we don't have your money" and i'd be ass out. Not going to happen!!!

Definitely. I do the free t-mobile to t-mobile thing for $6.95 I think. Way worth it for me, although come to think of it, Mom and Sis just got iPhones. Before that, the whole famn damily was T-Mobile. Hmm.

You usually have 60 days to cancel your contract once the merger is complete. The way most companies get around that, is they stick a insert within bill, among other trash that you would usually throw away. By not responding this, you agree to this.
