I have a previous employer that's owed me a lot of money for too long. I need someone who can help me get my money from this twit.

There's a law that allows you to collect interest earned as a result of waiting for a paycheck BTW; as long as you are not at fault for the wait time.

Any EEO Lawyer or Tort Lawyer will work.

I'll ask about that.. It was work done on a 1099 basis.. Been almost a year now and now he's not answering email or returning phone calls. I also know that he finished the project and got paid recently. Months ago he paid me 1/3 and he asked me to be patient and wait for him to get paid for the rest. So I did and I waited... Now there's no more excuses and he's really pissing me off.

On 1099 you a contractor, and you have to have a contract...unless like above says, he admits to the judge he would pay for the work. You going to have to file a debt collections claim, and majority of the time your just going to get stiffed anyway; even if you get the judgment. Never do a job where there is no collateral or payment first.

You can file a Tort case against them and establish a WoD and Public Record against the company. While this may not guarantee you a recoupment of funds, it most certainly will harm the company.

Additionally you can then place a lien against the company holdings until you are paid in full which carries a 20% compounded interest rate.

The only factor here is that you may get tied up in litigation for a decade or two if they have the overhead to keep a good legal staff on hand.

I just talked to some lawyer today.. What a ripoff.. They wanted $1,000 just to write a demand letter !!! Then they wanted a $2,500 retainer to get started if there was a court case. I can understand the retainer, but 1k to write a letter???? By last lawyer did that for FREE !!!

Its about $9,500 he paid some of it last time I got the lawyer on him...

Last email he admitted that he simply "doesn't want to pay me" until HE gets paid for the project. Its been a year now. Supposedly the product will get installed "soon", whatever that means.

Why not use the same lawyer then? He/she is already familiar with the case.

And what the fuck does "I dont want to pay you until I get paid" mean?

There's no contingency clause in your contract was there? If not, sick the lawyer on him now and make sure to add interest or at least adjust for inflation.

My lawyer dropped off the face of the planet... No idea why.. Maybe he died??? Been trying to get in touch with him for like 3 months now.. So I am looking for someone else.

"I don't want to pay you until I get paid": Means the project was a fixed price gov't contract where he does not get paid until delivered and accepted.

There was never a contract between us (there often is not in SW 1099 dev) but I do have records of hours, check stubs and his acknowledgment of the debt and multiple agreements to pay. Enough proof so that its not a problem.

Have you dropped by his office? It's really good to keep a lawyer who's already doing a good job on the case (if he's available).

Oh, and you're in VA right. Let me check w/my guy and see if he's licensed there as well.
