Need Lawyer - Driving under Suspended -Fairfax - June 5, 2009, 01:16 PM

I have friend that got pulled for speeding in a car. His License was suspended. He told the Copper that yes he knew it was indeed suspended. 2 Tickets - Speeding & Driving on Susp.

Background.
He knew it was suspended, becuase he recieved the letter the day before getting pulled over.
Where did he get pulled over? On the way to the DMV to get is Squared away, and get his license reinstated.

Why was his lic. Susp? He got a parking ticket that he paid, but somehow payment got lost in fairfax county system. Also notifications were sent to his old address, so since he never got a notifaction, he figures its all good, ticket paid.. move on.. right?

Fairfax sends notice to DMV to suspend license for unpaid ticket, DMV suspends license, and sends mail notification to my friend. DMV has correct address, so he gets the letter.

Next day goes to DMV, and gets pulled over for speeding. Sure, he should not have been speeding, he did not tell me if he was or was not. But he is definetely not guilty of driving on susp.. right?

I do think that if he walked into court and explained all of this that the judge would see it correctly... But Since my Friend is Indian, dark skin, and has a Strong Accent, I dont think he can explain it to where the court would hear him. (it is what it is... )

Do you have a refferal, or some advice I can give him? He's a Great person that totally does not deserve this.

No doubt the judge should drop the Driving on Suspended. There was not significant notification by the courts.

He'll most definitely get nailed for speeding.

but he got the letter stating he was suspended - so he knew.

that's the only way i got outta all 3 of my driving on suspendeds...when the judge ask the cop if proof of the notification was mailed, the officer couldn't present the proof, so since I wasn't adequately notified, cases were dropped.

obviously get the license squared away before going to court.
i'm sure if he brings in the proof that the parking ticket was paid prior to receiving the suspension letter - then he should be ok.

but what does suck is that he may now have to pay the DMV fees to reinstate the license $85 + $10 for a new license, even if the case is dropped or not, I know I had too. But again, I'd present the paid ticket proof to the DMV and the court. You can't go to the DMV and be like yo, my case was dropped, I don't need to pay - it doesn't work like that.

if he mailed in a check or money order to pay the parking ticket and it was recieved/processed after the due date - it's a wrap, paid or not.

and oh, no lawyer is needed for this. He can do all the leg work himself and present it in the courtroom. Just make sure he pleads not guilty so he'll have a chance to present his information.

Thats where I think he'll need someone to represent him, He's an indian guy with an accent, I hate to say it, but I dont think anyone really gonna try to listern to him. I've seen how Fairfax County can just push people through...

I'd feel better sending him in with an attorney...

Worse he will get is 12 hours in the community tank should be out by midnight that day....goes on his record as a misdemeanor.....unfortunately the fact that he knew and said he knew will screw him but it shouldn't be that bad.
