New MD Cell Phone Law Goes Into Effect Oct 1st - September 24, 2013, 03:01 PM

New cell phone law takes effect in Md. Oct. 1 | wusa9.com

Now a primary offense. No longer a secondary, which means you can be pulled over solely for using your phone.

*Changes to Maryland Traffic Law Cell Phones and Seatbelts
Effective Oct. 1:

Driver using hands to use handheld telephone while motor vehicle is in motion will be a primary traffic offense:

1st Offense is an $83.00 FINE, including court costs
2nd Offense is a $140.00 FINE
3rd and Subsequent Offense is a $160.00 FINE

If the violation contributed to an accident, THREE (3) POINTS will also be assessed in addition to the fine.
Driver using hands to use handheld telephone while operating a commercial motor vehicle, first offense is a $290.00 fine and also a primary traffic offense.

The following violations are now $83.00 fines:

Failing to secure a child under age of 8 in a child safety seat when transporting in a motor vehicle.
Failing to transport a child under age of 16 in (child safety seat per instructions, seatbelt).
Using a (child safety seat, seatbelt) to (restrain, seat, position) more than one individual.
Operating a motor vehicle with (operator, occupant under age 16) not restrained by (seatbelt, child safety seat).
Passenger age 16 or more in outboard front seat of motor vehicle without seatbelt restraint. Example of an "outboard front seat" is a front passenger seat next to a door.
New Secondary traffic offense:

Passenger age 16 or more in rear seat of motor vehicle without seatbelt restraint. The fine is $83.00, including court costs.

They might as well pass it in VA too so MD, VA, and DC are consistent with one another. I get tired of seeing out of state drivers in DC talking on their handsets.

3rd offense really should be loss of license for 30 days.

While I see this as a step in the right direction, I would like to see some evidence that hands free vs. handset really makes a difference. Theoretically, handset does affect instantaneous reaction ability, but so does driving with thumb and forefinger while eating a big mac.

In fact, I think there have been studies to show that even talking to someone while driving is nearly as bad as using a handset. But the reality is that some people can handle it, and a lot of people cannot. Poor driving is the problem, whether caused by distraction, lack of ability, or blindness (which I would facetiously argue is the leading cause of accidents around DC).

Understanding the difficulty in making laws that strike the balance between protection and liberty, and trying to tailor them to the middle of the bell curve, I can't complain too much, but there is still much more to be done. I fear that these laws, like most gun laws, are feel good legislation that won't actually mean a difference in the number of fatalities or wrecks.
