Not really true from someone in the know. Besides it would upset Congress who has a big say in future Navy procurements.

It's a tough place to be. If you don't charge him, then you are only applying the law when convenient. If you do, you are further punishing the victims of an idiotic and unjust policy.

What I'm unsure of, though, is whether he is going to stand military trial or not. I would charge him with UCMJ violation, and then have convening authority dismiss the case.

Yes, I know the problem with this is his record is ruined and he won't have a chance at promotion - yet another idiotic "zero defect" mentality, for which the system needs to be slapped in the face and made to do right.

I'm talking as a hypothetical idealist here, but the specific laws and policies are the problem, not the universal application of justice based on the same law for everyone.

Everyone is charged in a shooting. You think you wont get charged for discharging a firearm within city limits if you shoot an intruder? Doesn't mean they stick or you receive any punishment.

When there is absence of malice and clear and present, assured self defense the Prosecutor usually exercises discretion and declines to file charges even when a minor law was broken in the commission of the act.

This prosecution, if true, is one of those moments where justice is not served by filing charges.

That remains to be seen.

Would you suggest NBC (Brian Williams), maybe MSNBC?

nope

I'm not aware of any decent size US news outlet that does not display a significant bias when reporting on domestic politics. It will only get worse over the next few months.

The sad state of affairs is that trash like WND (on both sides) provide sound bites that sheeple regurgitate willingly. As the saying goes : “Think of how stupid the average person is, and realize half of them are stupider than that.” Just makes the whole thing a pretty sad sideshow when arguably some pretty important issues/future steps are at stake.

Navy: No Charges Against Officer for Weapons Violations in Attack | Military.com

Pretty much opens up Pandora's box for anyone else to carry if you ask me.

I love the "at this time" quote in reference to his being charged....perhaps after the election.

Yep. Damned if they do, damned if they don't. It should be a very good eye opener for those in charge that the policy needs to be revisited, and something that does more than just look good on paper should be established.
