is there really any point of citing a president for something that is short of an impeachment? What reprocussions does this bring up? Does he pay a fine?

It's probably in the video, but I can't watch at work.

Alot of people chiming in but saying not much of anything.

Fact is, that according to the Geneva convention, these people that this case was about could have technically been shot site on seen because they can be rationally defined as spies (ie enemies in plain clothes).

You want to get up in arms about some other things that he has done, feel free. I disagree with several things, however, nothing he has done to this point could be deemed an impeachable offense. Don't you think that given the current attitude toward this administration that rumblings in Congress would have risen so high if they had the data to prove anything.

the significance of judicial review is not that it literally punishes the executive for violating the constitution or in this case international law, it's that a ruling such as this one stops him from continuing to do so.

by the way, presidential impeachment occurs in congress, not the supreme court.

very interesting read

One main reason why iraqi prisoners are in Guantanamo Bay, Cuba. If the prisoners hit U.S. Soil, they have U.S. rights...so the easy answer. Put them in a military base not located in the U.S., they go by international laws rather than U.S. laws. I think everyone has seen enough to know that this administration are pushing the limit in lots of ways from treatment of prisoners to trying to push the checks and balances. The sad thing is that congress is trying to pass a legislation that will allow President Bush to continue to prosecute prisoners in a Military court. Just my input...when is the next election? needs to come around sooner...

Emotionalism is often based on a general feeling that something is wrong. If undefined it often leads to inappropriate responses to problems that ARE legitimate.

He is not impeachable, just because you don't like the forceful, even heavy handed way that he approaches problems does not mean that he is necessarily doing anything wrong from a legal standpoint. In a more indefinable and obscure way people are beginning to feel that the attitude with which the current administration approaches issues is not appropriate. People feel that Bush is un-checkable, and they may be quite right in many ways.

This is why power groups are so dangerous, if they become to powerful, the checks and balances that control a given power group are no longer equal, and therefor unable to balance. Power groups are deadly because, though at first they appear to be dynamic in problems solving (ie fighting back after 9/11) they often outgrow thier purpose and take on a life of thier own (ie US becomes the world police especially in the middle east, biting off more than it can reasonably chew). These are what dictatorships are born of, Hitler is a great example.

Empower the counter balance and you achieve balance... at least for a little while.

I’ll agree…the President is, does, and has pushed the gray envelope of Executive power…as had Lincoln and FDR (in many ways more so) under national duress and in the execution of their primary responsibility…to protect this nation and its interests from enemies foreign and domestic.

Tough nut with this enemy and in these days and times.

For me…so far he’s been successful…even with the blunders, our typical national restraint for humanity, and dodging the political enemies within.

But all that this Supreme Court decision causes (and I’m pleased) is clarification and slight modification of some current law and military law.

The Legislative branch will support the changes to allow military tribunals, especially after the sick joke and sham of a of the trial of Zacarias Moussaoui in civil court.

Also, for those that want the detainees released on a humanity basis…you’ve really done them harm…do you not think their dossiers, files and whatever evidence will not be handed over to the repatriated country? The likes of Egypt, Jordan, Syria, Saudi Arabia…

…now there are some humane prisons.
