Not bike related...


If you are arresting someone who doesnt have ID on them. What steps are taking to make the arrest?

I have a friend who just found out his license is suspeneded and there is a bench warrent out for him due to charges from Oct 06. Someone used his name, he wasnt even living in the state at that time. Whats even more fucked up is we think we know who did....his crudy sorry excuse for a brother.

HE has a trial date for May 16....


So what are the possible out comes for such a situation? Seriously this bullshit, a waste of tax payers dollar, lazy police work (sorry), going to cost money, and could ruin someones life!


Any input would be helpful in knowing what to expect or what steps to take. He has started paperwork for Identiy Theft.

credable alibi, he needs to verify where he was at the time, he will need a good reference like work or several(more than 3) people verifing where he was, "I was at my mom's house" is not gonna cut it, good luck!

If no Id is present they will usually take him in, run him through a lifescan (pictures, fingerprints, etc.) and match you up with records taken on prior offenses or from DMV.

If there are no fingerprint records on file, they only have pictures to go off of, and brothers can look similar. If this is indeed what happened, your friend should be able to prove he wasnt around, but it will be a a pain in the ass for him for a while.

I'm afraid at this point he has to deal with the courts and prosecutors, if he has a court date, it's out of the police's hands.

Expect the worst and come up with as much credibal evidance that it wasnt him and just play the game. Unfort, he will need a lawyer. Charge it to his brother b/c of the idiot putting him in that mess.

IF he is legit about being elsewhere, it shouldnt be anything more than an inconvenience to get it sorted out.

If your friend got stopped and the officer felt the need to "run" his name and he couldn't produce an ID.... then the officer could "livescan" (finger print) him to find a true identity. It all depends on what he did in the first place to get stopped. There's not much that the cop on the street could have done.... If your friend come back with an extraditable warrant then he's got to go. It all depends on what his brother did that got him in trouble but it shouldn't be too hard to prove that he wasn't involved. The alibi is a really good place to start. Hope this helps.

Hmm... similar thing happened to me in Maryland once upon a time. Hell if I can remember the outcome though - it was like 10 years ago.

A witness screwed up and gave my name in a hit & run case at the place I worked. I was contacted by the police by phone and voluntarily brought my car up to the station. Despite not having any damage, my car matched the description the witness gave and I was arrested and released without bail and given a trial date.

Lo and behold I later wrecked that car and come trial day, my ride didn't show up - missed my court date and had a bench warrant issued.

Went in a second time and this time I was arrested and had to post bail. Got a new court date. Went to court and it turns out the cop wrote the wrong ticket or something - some kind of technicality - so even if I had done it, I would have gotten off.

Ahh - happy days - as if I wasn't getting into enough trouble on my own back then.

If the brother was arrested, they should have his prints on file. Should be easy enough to have them run a comparison and prove that they arrested the brother and not him. Get it done before the trial date.
