I got a reckless driving ticket (25 over) on the way down to nags head. I asked the cop if he locked his radar in because i didnt believe i was going that fast and he said he its not VA policy to do that and he wasnt required to show it to me. I asked a friend of mine who is a cop and he said it doesnt matter its going to be his word against mine. Has anyone been in this situation before, because i have heard from people that i can get this dropped but im not sure. thanks

NC police don't play around. Basically it WILL be your word against his. Maybe if you go to court you can work something out with the DA and get it dropped to something lower...

Do you have other tickets on your record?

In Va, you don't have to show the person speeding the Radar becasue officers don't lock it in. They maintain a tracking history of the vehicle to make sure that your vehicle is the one that it is on. Now with Lidar, it's different. They lock in the speed and the distance the device was from the vehicle and they show that to you.
Here's some questions:
Was your vehicle the only one on the road?
Was your vehicle the biggest and fastest that was on the road? Was the radar checked before and after the issuance of the summons/ticket?
Was the radar checked with a calibrated vehicle or just tuning forks?
Which vehicle was the radar cehck against and how current is the calibration sheet?
A good officer will testify to this during his shpeel and a judge will pick up on any slip ups. The other thing is have you had your vehicle calibrated to show its actual speed. Many people go to an ACCEPTABLE calibration place and get that done and you can show the judge that your vehicle was off by 10-15 mph. Especially if it is a new vehicle. Judges will sometimes change the charge to defective equipment which is less severe. BUT that is in Virginia.
