Supreme Court rules - If you run from the cops, you can't sue - May 1, 2007, 10:25 AM

like this place needs more things to argue about.. lol

Quote:
WASHINGTON (CNN) -- The U.S. Supreme Court on Monday gave police officers significant protection from lawsuits by suspects who lead them on car chases.

The justices ruled 8-1 against Georgia teenager Victor Harris, who was left a quadriplegic after a police vehicle rammed his car off the road in 2001.

A police officer used "reasonable force" when ramming the teen's speeding car, the high court ruled. A videotape of the pursuit played a key role in the decision.

"The car chase that [Harris] initiated in this case posed substantial and immediate risk of serious physical injury to others," Justice Antonin Scalia wrote for the majority. "[Deputy Timothy] Scott's attempt to terminate the chase by forcing [Harris] off the road was reasonable."

The 11th U.S. Circuit Court of Appeals had ruled that Harris' lawsuit against the deputy could go forward. The justices overturned the lower court ruling, meaning the suit can be dismissed.

Nah, we'll still have the frivolous lawsuits... Hear about the DC judge who's suing a drycleaner for $65M over a pair of lost pants?

http://www.washingtonpost.com/wp-dyn...042502763.html

If the judges are doing it themselves, what chance do we have of this going away?

good for the supreme court ruling though, at least they're defendig the cops.

at the end of the article, it gives you faith that it will be shot down.

I heard recently that a cop was killed chasing a bike who was running from him. He got in an accident and was killed by his own car.

Doesn't matter.. the real threat of a frivolous suit is not so much that they'll win the damages they seek, but that you'll spend thousands in legal bills just defending yourself. Lawyers are notorious for doing this shit because it only costs them like 30 bucks to file a suit and they can do all the work themselves, most normal people have to hire a lawer to defend themselves at this point and for most petty things, it's easier adn cheaper to just settle and give the lawyer what they want. I've had to deal with this a couple of times now, having a lawyer pull the "i'm a lawyer, i'll sue you" crap, and to their face I just dismiss them and thell them to spell my name right in the lawsuit b/c they have no case, but if it ever gets down to it, it would probably be cheaper to settle. I'm still waiting for my subpoena from the latest angry lawyer threatening to sue.

was this the DC cop just a couple of weeks back? if so, that's not exactly the right story.

If that's the case, they should not be able to charge people running for manslaughter, murder or what ever it was if cop dies. Have the police ever thought of just stopping. If crimanl doesn't see police in the rear view than they wouldn't run. Since were talking about people safety here.

This one?: http://www.ksbitv.com/home/5379856.html

Recently sentenced but not the crash wasn't recent. Definitely should make anyone pause and think about the consequences OTHER than injury/death...
