GERMANTOWN, Md. - We have learned new details about a Montgomery County (web | news) student who says she was humiliated and traumatized after refusing to stand and say the pledge of allegiance.

Roberto Clemente Middle School students carried letters home to their parents with news of an apology. The public apology was to a 13-year-old girl and her family for a teacher's actions after the student refused to recite the Pledge of Allegiance.

"The teacher said she had to stand up for the pledge and he kept on asking her to but she didn't so he took her out the class," remembered student Rafael Garcia.

Lawyers say the girl's mother contacted the American Civil Liberties Union after the girl was sent to her counselors' office and she refused to say the pledge again the next day. The ACLU says the teacher not only called a school resource officer to escort her out of class but lawyers claim the teacher called her names.

"Others students seeing that he was calling her names calling her stupid and students began to jump in," said an ACLU lawyer.

Student Rafael Garcia told us, "She shouldn't have been taken out of class."

"We have the right to freedom of speech so if she didn't want to say it why is she being persecuted for that?" asked one student.

The school system admitted the teacher violated policy and said he would deliver a letter of apology to the student by day's end.

Germantown resident Sazia Moriom said, "She has a right, a right to refuse, and he definitely should do that."

"Well, you have to do what you have to do to keep your job but I support the teacher," stated parent Valerie Lopez.

The principal wrote to parents and students about patriotic exercises saying "...no one will be permitted to intentionally embarrass you if you choose not to participate..."

Former student Marissa Kaiser suggested, "I think that if she was not going to do it he should have just ignored her."

"I think she should have if the teacher asked her to but I think the attention is too much," said former student Anna Majack.

The ACLU lawyer says the teacher will apologize to students and explain what he did wrong. The family says they are satisfied with that and won't pursue any further legal action.

My Stand: First let me say I feel very loyal to this country, I stand with my heart crossed and I say the pledge but this wasn't always so. In school I really resented being forced and felt I was being somewhat brainwashed like other countries did to their citizens. When I got older and really realized how lucky I am and the fact that I have a choice to say it or not I now choose to because of my love for this country. I have presented the argument that countries like Russia or Germany would have killed you under Stalin or Hitler for simply not soluting but we have a choice.
Many will say our soldiers die for this country and out of respect we owe our allegiance. My stand is the soldiers go and fight so we can have a choice and whether they disagree with not saying the pledge or not and even if they don't agree their sacrifice gave us this ability to choose. This fact alone made my choice simple of why this country is so great but until someone comes to that conclusion on their own aren't we going against what our soldiers really fought for in the first place FREEDOM!
If our soldiers believe in a God for example does that then force me to believe in one just because they did or does the basis of our country give me the right to choose no matter what our soldiers believed?

Holy hell! My old neighborhood!!! Was wrong for her to embarass that kid...it is freedom of speech especially....but...

WTF is matter with someone who doesn't wanna do the pledge...if you don't respect the country you can GTFO. She has a right not too....millions have died protecting that flag and that right but jeebus, have some class.

Silly . . . what if the student isn't a U.S. citizen or doesn't believe in God? Glad the teacher is apologizing and that the family is ok with an apology. Everybody gets to move on.

She's in America...attending schools paid for by citizens tax dollars...she wasn't forced here. She should respect that at least, getting top-notch Montgomery County education for free. Or at least stand up and not recite the pledge. The teacher had a normal human reaction, it would shock most people seeing this obviously poorly raised child do this.

Yeah, she should have stood. IMO both parties were partially wrong. Maybe the student will stand next time, maybe not. Benefitting from a country doesn't mean you should have to pledge allegiance to that countries flag.

I question why most kids even do it. Do they really understand why or is it just because they have been made to from an early age. Would it not be wiser that the teacher have seen this as a learning opportunity to discuss with all the children why it is we say this?

BULL CRAP.

If you don't like the free education and you don't care enough to learn about your freedoms then GTFU. If a teacher can't even tell her students what to do, what is next?

What if Jonny doesn't want to do his pop quiz since he has the right to remain silent? Will the ACLU jump all over that too?

I think it’s sad how people like to take advantage of the freedoms and liberties afforded in our country and don't take the time to show some respect and appreciation for those who have gone before them to make it happen. The ingratitude and abuse of these liberties that have cost so many so much makes me sick.

Since I don't believe in a GOD and I wasnt born in those countries it was an act of fate if you will that I am here, this country didn't go and get me from IRAQ and when I got older I pay my part in taxes to pay for what we all enjoy we all contribute to this freedom in someway.
To blindly show loyalty to me seems as dangerous as someone not showing it at all. I am part of a system and to me I am pledging my loyalty to continue to do my part, voting, donating, paying my taxes, some do more than others.
That little girl may have just never been taught and I bet she feels even less need to say it now that the teacher, other students etc all jumped on her.
The beauty of freedom of speech is we all have it and sometimes people express it in ways that not everyone agrees with but at the heart of it just sit back and look. Hey, You know what you were able to do that because this country is fucking awesome and I feel even better about where I live. Maybe someday you will to because you will eventually realize you couldnt have done that just anywhere!
Take the opportunities to teach when they really matter and just forcing her to do something is completely not what our soldiers fought for!

An adult ok, but a kid who may never been taught why we really do this what good would come from being so harsh?
Maybe the teachers husband fought and died in a war and it really struck a nerve and she flipped. OK I can see that but as a teacher shouldnt you have enough intelligence to realize there is more going on here.
I don't know it seems like we all like to take about how free we are in this country but when someone really exercises their personal freedom and it differs from the majority we go off the deep end and can't see the forest for the trees so to speak... Maybe we shouldn't be free. Lets make it law everyone vote and get a real majority rule on every issue and the minority can just go bite themselves! Of course if they left this country and we either went to war with that country or a natural disaster happened we would be supporting them anyway so what's the point!
