What is this world coming to? You start a fight with an individual after threatening them for several minutes, unlawfully trespass, surround and approach them in a threatening manner, get your ass beat for your troubles and then sue them for beating some sense into you.


I hope this guy launches a countersuit for emotion distress and the lost time and wages he incurred since McDonald's fired him even though he did nothing wrong.

A woman who admitted she started the violent fight in a Greenwich Village McDonald’s that sent her to the hospital is suing the burger-flipper who gave her a fractured skull.

Myika Darbeau, 25, filed papers in Manhattan Supreme Court charging that Rayon McIntosh, 32, used “unnecessary, excessive and unlawful force” in the October 2011 incident at 136 W. Third St. Darbeau also is suing the owner of the franchise, charging there was inadequate security and the store never should have hired someone with “brutal, dangerous, vicious propensities.”

Police originally arrested McIntosh, saying he assaulted Darbeau (who was using a first name of Denise) and her lover, Rachel Edwards, with a heavy-duty grill scraper. A grand jury refused to indict McIntosh after seeing a video showing that Darbeau and Edwards jumped over the counter and started the fight.

McIntosh, an ex-con who got out of jail in March 2011 after spending a decade behind bars for killing a friend, was released, but the two women were charged. They pleaded guilty last month to starting the fight and got probation.

They don't give a shit about him. They know he has nothing. They included the McDonald's franchise owner in the lawsuit. Deeper pockets. I'm surprised that they didn't include the McDonalds mothership. Nuisance lawsuit...or hoping to get a "hot coffee" type of settlement.

In the end, the defense just needs to keep re-playing the fact that the two idiots were belligerent and aggressive and cornered him in the back. Cornered, just out of prison...of course he defended himself with anything at hand.

Many times it doesn't matter. You can get cleared of wrongdoing on the criminal side and te faggots can still sue you on the civil side

Personally, I have always felt that a case that has both Criminal and Civil court charges is akin to double jeopardy.

As Criminal court has the much higher standards and burdens of proof, if one is found innocent in criminal court it should automatically nullify any rights to a Civil trial.
