Manassas man pleads not guilty to murder charge [News & Messenger, Manassas, Va.]


(Manassas Journal Messenger (Woodbridge, VA) Via Acquire Media NewsEdge) Apr. 14--On Jan. 13, 2008, John Robert Anderson did a lot of things he shouldn't have done, Assistant Commonwealth's Attorney Richard Conway told a jury in Prince William Circuit Court on Monday.

He shouldn't have drank so much alcohol.

He shouldn't have taken drugs.

He shouldn't have invited himself to a house where he was not welcome.

He shouldn't have started a fight there.

But he also shouldn't have died.

Christopher Edward Nicely, 23, one of two men charged in Anderson's death, pleaded not guilty to first-degree murder Monday at the start of what is expected to be a three-day trial.

In his opening statement, Conway told jurors that Nicely kicked Anderson to death during a fight.

Nicely's defense attorney John Carroll said that another man, Jason Ward, was responsible for 46-year-old Anderson's death that night.

Ward is also charged with murder and is expected to stand trial in May.

According to court testimony Monday, the events of that night began at City Grille on Sudley Road in the Manassas area.

There, Anderson overheard Nicely and another man, Carlin Beavers, talking about going to Beavers' house to play the guitar.

Nicely was like a grandson to the then 69-year-old Beavers and often visited his house to check on him and to play the guitar, Beavers said.

Anderson, who did not know either of the other men and who Beavers said appeared to be drunk, said he wanted to go listen to the music.

Anderson said he wanted them to play "Z.Z. Top music," but Beavers, who plays bluegrass, said he did not know how.

"I said 'I don't play that kind of music and I don't want you to come to my house,'" Beavers said in court Monday.

But Anderson followed Beavers to his house in the 5200 block of Sudley Road anyway, Beavers said.

Beavers said he again asked Anderson to leave, but he followed the men into Beavers' workshop where Beavers and Nicely planned to play the guitar.

"He just wouldn't take no for an answer," Beavers said.

At some point Ward, who Nicely had invited, also came to the workshop, Beavers said.

While in the workshop, Anderson again asked Beavers to play "ZZ Top music" and Beavers again said he didn't know how.

Anderson got angry and pushed Beavers, knocking him to the floor, Beavers said.

Beavers said he heard Nicely say "Don't beat on Grandpa. He's not well." Beavers then passed out and does not remember anything after that, he said.

Conway said other witnesses will testify that Nicely and Anderson fought outside the workshop and Ward later came to Nicely's defense.

When Anderson stopped fighting back, Nicely kicked him repeatedly while he was laying on the ground, causing severe injuries to his head and torso, Conway said in his opening statement.

Nicely and Ward later put Anderson in the backseat of his car and drove it to Robin Drive, less than a mile away and left him there.

Police found Anderson dead in his car the next day.

A medical examiner said Anderson died of blunt force trauma to the head and torso.

Toxicology reports showed that Anderson had cocaine and marijuana in his system. His blood alcohol content was about three times the legal limit for driving, a forensic toxicologist said.

Nicely and Ward turned themselves into police on Jan. 17, after learning that Anderson's body had been found.

Nicely's trial continues today.

But he told a jury in Prince William Circuit Court that his testimony Tuesday was the truth.

Ward testified during the second day of Christopher Edward Nicely's murder trial. Both Ward and Nicely are charged with first degree murder for the January 2008 death of John Robert Anderson.

Ward, 25, of the Occoquan area, is set to stand trial in May.

Nicely, 23, of the Manassas area, pleaded not guilty during the first day of his trial Monday.

In his testimony Tuesday, Ward told jurors that the story he first told police about what happened the night Anderson died was not true.

He said Nicely made up that story and told him to go along with it.

Ward said he went along with the story for a while, but then changed his mind.

"I didn't want to go to my trial not saying what happened," Ward said.

He said telling the truth now "just seemed like the right thing to do." In his opening statement at the start of the trial, Nicely's defense attorney John Carroll said Ward's version of the events was not true.

He said Ward changed his story not to tell the truth, but to help himself.

"In every way it's changed, it helps him and hurts Christopher Nicely," Carroll said.

According to court testimony, Anderson, Nicely and Ward were all in a workshop at Carlin Beavers' house in the 5200 block of Sudley Road on Jan. 13, 2008.

Nicely and Beavers, who he called Grandpa, had planned to play guitar at the workshop that night.

Nicely had invited Ward, his friend, to come along.

Anderson did not know the men, but followed Beavers home from a bar because he wanted to listen to the music.

Beavers said Anderson was not invited and he asked him to leave.

In his testimony, Ward said that at first it did not seem that Anderson was unwelcome.

He said the men were hanging out in the workshop, drinking and listening to music.

Ward said Anderson was "extremely intoxicated" and started making "requests that didn't make any sense." Beavers said Anderson repeatedly asked him to play "ZZ Top music" but Beavers, who plays bluegrass, did not know how.

At one point, Anderson pushed or punched the 69-year-old Beavers, who fell to the ground.

Nicely told Anderson to leave and the two began fighting, Ward said.
Eventually the fight moved outside the workshop and Ward went to Nicely's aide, Ward said.

Ward said Anderson fell to the ground and both Ward and Nicely kicked him.

Anderson got up again and the fight continued.

Ward said that when Anderson fell a second time, Nicely, who Ward said was wearing steel toed boots, again kicked Anderson, and continued kicking him several times after Anderson started fighting back.

Ward said that's when he pulled Nicely off Anderson.

A short time later, Ward, Nicely and Beavers talked about what to do with Anderson, who appeared to be unconscious, Ward said.

Ward and Nicely decided to put Anderson in the backseat of his car and drive it less than a mile away to Robin Road.

Anderson was found dead in his car there the next day.

Nicely and Ward turned themselves into police on Jan. 17, after reading in the newspaper that Anderson had been found dead.

Ward said that before turning themselves in, Nicely told Ward they needed to give the same story to police and specified what the story should be.

Nicely said to tell police that Anderson had banged his head on the walls and benches in the workshop, to explain the head injuries, Ward said.

"He said to exaggerate the way Anderson was acting and not to say he was kicking him the way that he was," Ward said.

A medical examiner said that Anderson, 46, died of blunt force trauma to the head and torso.

Nicely's trial continues today.

Regardless, their lives are ruined because of what happened as a final outcome.

It doesn't seem like their defense is going to hold up too well, especially with the actions they took after the deceased supposedly went "unconscious".

Sad situation, but yeah I'll keep looking for updates myself. Thanks Justin.
