Ok so heres the deal... and yes I am prepared for you to laugh at me.

So I fired the fucktard who created my Drive Auto Brokers website.
That went ok... then I dehorsed him from his demo (car)
and he shut downmy website.
I am fucked! I think.

I need help doing any of the following...
1) Creating a new site
2) Hacking my old site back into my control
3) Beating the shit out of a geek!

I'm sure your fist question will be about the domain name. Which I authorized him
to buy with company money, but I have zero control over. The most important
thing to me is getting the name back. www.driveautobrokers.com

Please help.

Yea... he owns it dude, your site is gone. Hacking it will be extraordinarily illegal... though not difficult.

Build a new site, Paul can probably do it in a week or two. Probably run you about $400 maybe more depending on if you have a database backend for searching your inventory... I'm not really sure.

getting the domain back will require an appeal to either Network Solutions or ICANN itself, but it'll work in your favor if you have paperwork showing you paid him to register the domain for you and such.

This is it dude. I know of one appeal that took 4 months to even get processed and over 9 to be litigated or whatever process they go through. Domain names are $60 dude.

He doesn't own it if he was a contractor, unless specifically covered in some sort of statement of work or contract. The owner of the domain name is rightfully the person paying for his services. If no contract was drawn up at all and this was just sort of verbal communication work, its still a verbal contract, and absent any proof of an agreement that the developer retains ownership, then the owner of the product of the work is the person paying for the work to be performed. This is an easy case to win.

If he doesn't give it up, its time to talk to a lawyer, you can sue for damages to your business. Additionally, the site/code itself belongs to you unless otherwise specified. You paid to have it produced, you are the owner, not the developer. If he destroys it, you can sue for the amount you paid to have it developed.

Set something else up in the meantime, but pursue your case, it looks like you've potentially suffered substantial damages.

It's really simple if you think of it in different terms - imagine you paid a contractor to install a wood fence around your property and maintain your lawn. You later fired the contractor, after he was paid for his services and the fence was completed - and he turned around and removed the fence. The contractor has rights to the payment for his services, but absolutely no right to the fence.

You own the product of a contractors efforts and all necessary materials obtained while under contract. This includes the website code and the domain name. Your developer should settle out of court.
