What's going in folks? I am battling with my home warranty company for the last 5 months on a refund that I am due and have been lied to countless times about the check being mailed and still to this day, no check. I contacted a small claims lawyer in FBurg and they want $1500+ for court (warrant in debt) and $300 for a threatening letter. Does anybody else have experiences with this? FYI I am dealing with Sensible Home Warranty if that helps at all.

Screw that asshat, file yourself. There will be costs associated (filing fee, warrant service,...) but very minimal compared to what the bloodsucker wanted.

Also you can usually call the clerk of court with questions.

Before you file, send a certified letter stating that you are done dicking around with them, and if you do not receive funds by X date (15 days is good) you will be filing a small claims suit here in VA. Not a bad idea to cc the letter to their legal department to get the skids greased.

If they show up, they lose. If they don't, they lose. Most likely you will get your $$. If not, make sure you ask the judge for the cost of filing in the judgement.

Make sure to send a CC: letter to the following:
- State Attorney General, Consumer Protection Division
Maryland Attorney General - Consumer Protection Division

- Better Business Bureau

- Maryland Insurance Commission
Maryland Insurance Administration - Home Page
(Home Warranties are a form of insurance and can fall under their purview even if not regulated)

If they value doing business in the state, they will respond to the inquiry from one of these organizations and your check will overnighted if not personally delivered via courier.

Cool...my assumption for these letters would be keep it factual with little to no emotion correct? Only listing dates of calls/emails and all that type of stuff.

Correct. Express your frustration but keep it professional. Once the company is contacted by one of these organizations, they typically have 30-days to respond.

call them and tell them they need to send the check fedex or ups with a tracking or certified mail since its been on its way for so long. once you get it in writing that its supposidly on its way and its keeps taking long that helps you in your court paper work

Best I can see besides posts above is call the FTC 1-877-FTC-HELP They'd probably give you same advice but it's worth a shot.

I have been dealing with this issue since July to be precise, but all documentation that they needed was submitted on Aug 26. Long story short, my check was mailed, then I was told I needed to submit more documentation after waiting 8 weeks for the processing of the check and 10 mailing days for the check. That BS has been on going ever since.

Letter drafted and set to be sent certified mail in the AM. Come to find out, they have been issued a cease and desist by the state of Washington back in January and the Nevada address is only a PO Box. The actual address is in Brooklyn and I now have the principal owners names as well!!!!!!! We shall see how this goes because I have put all of them as well as the managers I have spoken with in the attention field of the letter!

Nevada PO is for tax purposes. DE & NV are the least expensive states to incorporate by way of corporate income tax.

Brooklyn based warranty/ insurer? Unless their address is in the MetroTech Center, or anywhere in the vicinity of Downtown Brooklyn or Bklyn Heights, then ....
