who has right away in this situation? - October 27, 2009, 02:25 PM

Don't mind the shitty paint drawing plz. The brown represents curbs/medians. the green arrows represent what light that person has.

A driver is in a left turn lane, and does NOT have a sign indicating U-turn is illegal. Once the left turn arrow is given, he proceeds to uturn. Meanwhile, a driver is given a right turn green arrow, and begins to make a right turn directly into the path of the driver making a uturn. both have been given green arrows. Who's wrong?

you have to yield to the person to the right or if one is a main road and the other is a feeder the main road has the right of way first

INTERSECTIONS
The following right-of-way rules apply at intersections:
Drivers must yield where necessary to avoid striking pedestrians who are
legally crossing the road.
Drivers crossing a sidewalk entering or exiting a driveway, alley, or
parking lot must yield to pedestrians. It is illegal to drive on a sidewalk
except to cross.
Drivers turning left must yield to oncoming vehicles going straight.
At a four-way stop, the driver reaching the intersection first may proceed
before the other drivers (after coming to a complete stop).
Drivers entering a road from a driveway, alley, or roadside must yield to
vehicles already on the main road.
At an intersection where there is no stop sign or traffic signal (with the
exception of roundabouts), drivers must yield to vehicles coming from the
right.
When approaching a roundabout intersection, always yield to traffic in
the circle and pedestrians in the crosswalks. Wait for a gap in traffic
before entering.

Right-of-Way

When two vehicles approach an intersection not controlled by traffic lights or signs, neither vehicle has the right-of-way. Generally, Virginia law states that when two or more vehicles approach an uncontrolled intersection from different directions at the same time, the driver on the LEFT must yield to the driver on the right.
If the traffic lights at an intersection are not functioning, all vehicles approaching the intersection must stop. The driver on the left must yield to the driver on the right.
The law does not give the right-of-way to anyone. It only states which driver must yield to another.
Yield also means to stop if you cannot merge safely into the flow of traffic.

I don't believe one road can be seen as a main road in this situation. they both seem like big roads. The intersection I'm talking about is fair lakes parkway and west ox road. You brought up a good point. i've heard person to the right has right of way for stop signs, donno if that would apply at stop lights like this. I agree with mikeeb though, vdot needs to sign that shit so it's clear.

The person making the right should have the right away anyways, assuming they turned in the right most lane. The U Turner should make an effort to remain in the left most lane. right?

I've wondered about this too. And it's always bugged the shit out of me when the u-turner gives me a dirty look when I'm the one making the right. Fuckers.

I thought of that too, but i don't know of any car that can make a uturn within the space of one lane ie: it's gotta cross at least over one lane of traffic because of turning radius

the person making the right turn should be in the far right lane, and the person making the U in the far left, so the point is moot.

Whoever used the extra lane is guilty of making an illegal lane change.
