Who knows a lawyer? ... labor law issue - September 8, 2008, 07:47 AM

With out going into huge detail... I may be switching jobs and there's a big bonus from last month due to me.
I'm sure they are going to try to fuck me out of the money.
By law they have to pay me, but obviously by the time I get a lawyer and call the labor board... it will cost me more time and money then its worth.
I was hoping someone had a lawyer friend who could just throw a threatening letter on some letterhead.

PM me if any one can help.
Thanks

Is the bonus guaranteed in writing? If so, then they can't screw you out of it.

Is it a bonus or commission?

Typically you would have in writing you surrender future commission that you would rec. if you resign prior to reconciliation documentation.

Its a bonus... in writing.
Sell such number of cars in month of August and get said amount of money.

I know that I am entitled to it, but they will fuck with it anyway.
I feel if I have my ducks in a row prior to D-day...
and I can casualy say,
oh btw don't F with that bonus, I have spoken to an a lawyer.
That would be enough to deter the bullshit... especially if I go striaght to the top with it.

If you have it in writing, then you need to keep two things...

1) a copy of the signed bonus offer letter, preferrably original signature or notarized copy
2) a copy of the sales receipts showing that you sold at least the minimum amount required to receive the bouns

If you have those two things, they MUST pay the bonus. There is no way they can win in court if you've got that stuff.

can't... new job starts asap, and bonus money won't be allocated from Honda until like October

I know they will never win in court... I'm just trying to come out swinging with the lawyer letter to avoid all the bullshit.

Certified copies... just keep certified copies of everything... and in your resignation letter, be sure you state that you still expect to receive your bonus per the offer letter and receipts you have, and that you understand that the bonuses are not to be paid out until October or November.

$$$$$ coming straight from Honda, or the dealer? Dealers suck, been there, you that. If its in print you are still taking your chances. I got my GM money after I quit but made sure I quit after the cut off.
