Yet another reason you may want to THINK before you POST! - July 29, 2009, 09:11 AM

Could this happen to you? Think about the shops, people and places people often trash on this site. I am not a lawyer, nor am I giving legal advice. Just sharing an article. Enjoy!

ARLINGTON, Va. (WUSA) -- After joining Twitter six months ago, Raymond Bradley spent more time observing than posting.

"For me, I guess there's a privacy issue," said Bradley outside of a Starbucks on Lee Highway. "Everything I'm doing from moment to moment doesn't need to be broadcasted and once its out there, it's out there for good."

Its that permanency and lack of privacy that is coming back to bite one Twitter user in the form of a lawsuit. Amanda Brennen of Chicago posted a 16 word tweet that is now the reason behind a $50,000 lawsuit.

She wrote, "Who said sleeping in a moldy apartment was bad for you. Horizon Realty thinks it's okay."

The Chicago-based realty management company is suing Brennen for "maliciously and wrongfully" accusing the group of maintaining a moldy apartment.

Internet law experts say that libel laws still apply to the internet.

"If you make a false statement of fact about someone else, particularly in their business capacity," said Jon Praed of the Internet Law Group in Arlington. "You set yourself up for a libel claim or a slander claim. With social networking sites like Twitter, people put themselves at ease and forget they're really speaking to a larger community that's beyond their control. While their statements may be intended for family and friends, [those statements] may go well beyond that."

It all boils down to opinion versus a statement of fact.

Said Praed, "You can usually state your opinion. If you get beyond that you will open yourself up to the risk of a libel suit."

Truth is a defense. In this case, Amanda Brennen might have the burden of proving her apartment was in fact, moldy.

No. For instance, you can't say that Cheerios cause herpes. That would be a libelous statement you couldn't back up with fact, and General Mills would probably sue you if you failed to comply with the cease and desist letters they'd be sure to send you.

If this woman can prove that a) her apartment was indeed moldy/dangerous, and b) that the property management company knew about the hazardous conditions but failed to act, then she has nothing to worry about.

Truth is your absolute defense. You will NEVER be in any trouble for saying something that is factual. In case of moto shops, I think it's rather low to NOT warn people.

I usually just post. The thinking process never really happens at all, neither before nor after.
