to those who read about my crash about a week ago, good news this guy's insurance company has agreed to pay all my damages.

The bad news is that the adjuster told me that the kid's mother said she wanted to press harassment charges against me because I called him three times. There isn't really any substance to this since we had tense but civil conversations each time we spoke (only one tense conversation) and my "threats" were only that I would pursue further legal action if the insurance company didn't find him at fault. I also said I would contact the naval academy's honor code committee since I felt that he had changed his story since the accident. Still, anyone who presses charges on you has to make you nervous.

Coleman's picks up the bike on Thursday and I get everything fixed!

Ignore the mother. She's pissing in the wind. I had to have 'discussions' with a couple of parents in college when their kids damaged my streetbike. It's not harassment. 3 times is merely discussing the incident as it's resolution.

Drop it....I bet you she will. They are simply pissed about being at fault.

Question -
My bike has a little dink in the tank (dent), a little scratch on the pipe, a scuffed footpeg, etc. If they have to replace everything, I think the bike will be totalled, but they'll probably just give me trade-in value right? Unless there is underlying damage, the bike is totally fine and I don't really want to find what I could get with the small amount of cash I'd get out of a totalled bike (I think it lists 3300 on Kelly blue book). If I had a check and could do my own repairs I could get it back on the road really cheap, but I dont' think I could find a comparable bike for 3300. Any tips on how to deal with this?

I guess I'm also asking, if your bike is totalled they keep it not you right?

If they total the bike then they bought it from you. You could buy it back and fix it or not. Or if the damage is near total they could cut you a check for something less, then you don't have a salvage title on your hands. I imagine different insurance companies have different adjustment policies. Negotiate directly with the adjuster. Hopefully he has some flexibility to work with and is cool. If you have a loan on the bike your bank will have something to say about it too (if they find out).

Since I never crash, I only know about this second hand.
