Warning Graphic Pic - 9/19 t-bone - December 18, 2013, 07:56 PM

So the criminal case is done and the lawyer says I can post about it though the civil is still in progress.

This is me on the way to work at the Strathmore, northbound on Wisconsin Av in Bethesda at the intersection with Cheltenham as the Honda is about to hit us.

This is the concrete planter I smacked into before I landed on the ground.

This is the hole in my leg where the thigh bone ripped it's way out. (notice the dark area were bone should be showing) I asked the Officer responding to take this picture.
hole_sm.jpg
This is my baby after the Honda killed it.
baby.jpg
This is what my baby and me did to the Honda.

The guy plead not guilty.
His lawyer asked questions about how fast was I going and what is the speed limit there. Finally he made a motion that the was no evidence presented that it happened in Montgomery County.

The judge wasn't having any of it. Verdict guilty.

The hole in my leg was the only break in my skin. The left leg was pretty much crushed. I was hoping to post the xrays but I don't have them yet. Also some breaks in my left hand/wrist. I have five plates, three titanium in the hand/wrist. There have been six surgeries, several transfusions and I got to hear an ER nurse say I was bleeding out. I managed not to scream either at the scene or in the ER and I got off the drugs as fast as I could.

Now I spend six+ hrs a day in a CPM machine, got to two PT specialists once a week and that's pretty much going to be my life for another nine months or so.

Sorry no video but the thing is 45 minutes long and the crash is at the end. I'm running Linux and never bothered to get editing software so I can't make it presentable yet.

I've put up the max five images so I'll add more posts as I get the xrays and stuff.

Burn the video to a DVD and mail it to someone that can edit it.

How retarded does a lawyer have to be to argue there is no evidence of where it happened?

"There is no evidence this crash ever happened or that it took place in Montgomery Co. your honor. The 45-min of helmet cam footage is inadmissible because it cannot be verified, that in fact, it is the plaintiff wearing the camera."

Lol - lawyers.

Why the criminal case though? Was the driver over the BAC limit or speeding?

Nothing worse than being hit by a Civic driver. You know they don't have any f'cking money. In that neck of the woods you hope you could at least be hit by a nice E-Class. Or an Infiniti at a minimum.

Because she's got some damning evidence, a guilty verdict against the driver, and her bills will likely go way over the minimum insurance the guy currently has. Soooo, she's going after him long term. Attach wages, etc. That would be my guess.

Hope you are feeling better. Know you can't post anything about it yet.

If you want to mail a copy to me I can edit it for you.

Sorry you had to go through all that. I hope you get as much as possible in the civil suit. Getting awarded a judgement is easy. Unfortunately actually collecting it is a whole other matter. Good luck.

I've been seriously thinking about getting one just on insurance purposes alone.
